1st and 2nd Plaintiffs%u2019 claim against the 1st, 2nd and 3rd Defendants jointly and severally as follows:- (a)An Order that the Tenancy Agreement dated 21.10.2004, the 1st Supplementary Agreement dated 15.12.2009 and the 2nd Supplementary Agreement dated 11.12.2009 are rescinded; (b)Alternatively, a Declaration that the Tenancy Agreement dated 21.10.2004, the 1st Supplementary Agreement dated 15.12.2009 and the 2nd Supplementary Agreement dated 11.12.2009 are void; (c)The sum of RM300,600.00 being the rentals paid by the 1st and 2nd Plaintiffs to the 1st, 2nd and 3rd Defendants under the Tenancy Agreement, the 1st Supplementary Agreement and the 2nd Supplementary Agreement from the 01.10.2004 until 31.12.2012; (d)The sum of RM104,000.00 being the cost of clearing the Subject Land and the costs of erecting quarters for the workers working in the oil palm plantation; (e)Damages to be assessed for the 1st and 2nd Plaintiffs%u2019 loss of ceasing their plantation business on the Subject Land; (f)Aggravated / Exemplary damages to be assessed; (g)Interest at such rate for such period as this Honourable Court may deem fit; (h)Costs on an indemnity basis; or costs to be taxed unless agreed; and (i)Such further or other relief as this Honourable Court may deem fit. AND the 1st and 2nd Plaintiffs%u2019 claim against the 4th Defendant as follows:- (a)Damages to be assessed; (b)Interest at such rate for such period as this Honourable Court may deem fit; (c)Costs; and (d)Such further or other relief as this Honourable Court may deem fit.

The action against the 3rd defendant is withdrawn with no order as to the cost. As for the 4th Defendant the action is also withdrawn with cost of RM1,500.00.on 25.03.2014. Judgment is entered against 1st & 2nd defendants and the defence and counterclaim of the 1st & 2nd defendants are strike out on 25.02.2014.
