WHEREOF the Plaintiff claims against the 1st, 2nd and 3rd Defendants jointly and severally as follows: - a) the sum of RM36,894,833.04; b) agreed and additional payment interest at the rate of 2.75% p.a. above the Plaintiff’s BLR (the Plaintiff’s current BLR is at the rate of 6.60% per annum) on the said sum of RM3,718,628.51 (Overdraft 1 Facility) on daily rest, on compounded basis from 1st February 2013 till full realization; c) agreed and additional payment interest at the rate of 3.00% p.a. above the Plaintiff’s BLR (the Plaintiff’s current BLR is at the rate of 6.60% per annum) on the said sum of RM15,186,569.69 (Overdraft 2 Facility) on daily rest, on compounded basis from 1st February 2013 till full realization; d) a greed and additional payment interest at the rate of 1.75% p.a. above the Plaintiff’s BLR (the Plaintiff’s current BLR is at the rate of 6.60% per annum) on the said sum of RM18,568.59 (Term Loan 1 Facility) on monthly rest, on compounded basis from 1st February 2013 till full realization; e) agreed and additional payment interest at the rate of 2.50% p.a. above the Plaintiff’s BLR (the Plaintiff’s current BLR is at the rate of 6.60% per annum) on the said sum of RM1,655,359.43 (Term Loan 4 Facility) on monthly rest, on compounded basis from 1st February 2013 till full realization; f) agreed and additional payment interest at the rate of 3.00% p.a. above the Plaintiff’s BLR (the Plaintiff’s current BLR is at the rate of 6.60% per annum) on the said sum of RM11,409,796.86 (Term Loan 5 Facility) on monthly rest, on compounded basis from 1st February 2013 till full realization; g) agreed and additional payment interest at the rate of 2.75% p.a. above the Plaintiff’s BLR (the Plaintiff’s current BLR is at the rate of 6.60% per annum) on the said sum of RM4,905,909.96 for (Term Loan 6 Facility) on monthly rest, on compounded basis from 1st February 2013 till full realization; h) costs on solicitors and client basis; and i) such other relief this Honourable Court deems fit to grant.
Enclosure 29 is allowed ,2nd &3rd Defendant's Defence is struck out. Judgment is entered against both 2nd & 3rd defendant as prayed with cost of RM 10,000.00 which includes the cost of this application.
